Draft — not yet reviewed by a lawyer. These terms are complete enough to read and rely on as a statement of intent, but they have not been reviewed by counsel, and governing law has not been set. They will be reviewed before Vizra is listed publicly on the App Store.
1. Agreement
By using Vizra you agree to these terms. If you do not agree, do not use the app.
2. What Vizra is
Vizra is a navigation and awareness app for riders of motorcycles, scooters, e-bikes and bicycles. It shows nearby riders, warns about hazards other riders have reported, provides turn-by-turn directions, and records rides.
3. What Vizra is not
Vizra is an aid to your attention, not a substitute for it. It does not see the road. It knows only what other riders’ phones report, and it can be wrong, late, incomplete, or silent — because of a lost signal, a dead battery, a rider who is not using the app, a hazard nobody reported, or an ordinary software fault.
- An absence of warnings never means an absence of danger. Most road users are not on Vizra at all.
- Never operate your phone while riding. Alerts are spoken so you do not have to look at a screen.
- You remain responsible for riding safely and lawfully at all times, including obeying speed limits and traffic law regardless of what any route or alert suggests.
4. Riding involves risk
Riding a two-wheeled vehicle carries inherent risk of serious injury and death. Using Vizra does not reduce that risk, and you accept it as your own. Wear appropriate gear, ride within your ability, and do not ride impaired.
5. Eligibility and your account
You must be old enough to lawfully operate your vehicle where you ride, and at least 13 years old. Accounts are anonymous; you are responsible for the device you use to access yours.
6. What you contribute
Hazard reports, rides, groups and challenges you create are yours. By posting a hazard you allow us to show it to other riders, since a hazard report nobody else can see would be pointless. Do not report hazards that do not exist, use Vizra to harass or track a specific person, or post anything unlawful.
7. Emergency features
The SOS feature notifies contacts you have chosen and riders nearby. It is not an emergency service and does not contact one. It depends on your phone having power and a signal. In an emergency, call your local emergency number.
8. Availability
Vizra is provided as-is. We do not guarantee it will be available, accurate or uninterrupted, and features may change or be removed.
9. Assumption of risk
You understand and accept all of the following as a condition of using Vizra:
- Riding a two-wheeled vehicle on public roads carries an inherent risk of collision, serious injury, and death. That risk exists whether or not you use Vizra, and using Vizra does not reduce it.
- Hazard reports, rider positions, safety scores, coaching, and route guidance are generated from consumer phone sensors and from what other riders choose to report. All of it can be inaccurate, delayed, incomplete, or entirely absent.
- You are solely responsible for how you ride, for obeying traffic law, and for every decision you make on the road, including decisions you make after seeing or not seeing something in Vizra.
You accept these risks knowingly and voluntarily, and you agree that you use Vizra at your own risk.
10. No warranties
Vizra is provided “as is” and “as available,” without warranty of any kind. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or usage of trade.
We do not warrant that Vizra will be uninterrupted, timely, secure, or error-free, that any hazard or rider will be detected or reported, that any alert will be delivered or delivered in time to be useful, or that any information in the app is accurate or current.
11. Limitation of liability
To the fullest extent permitted by law, neither Vizra nor its owners, employees, contractors, suppliers, or licensors will be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your use of or inability to use Vizra, whether based in contract, tort (including negligence), strict liability, or any other legal theory, and whether or not we have been advised of the possibility of such damages.
To the fullest extent permitted by law, this includes any claim arising from personal injury, death, or property damage connected to your operation of a vehicle, and any claim based on a hazard, rider, road condition, or emergency that Vizra failed to report, reported inaccurately, or reported too late.
To the fullest extent permitted by law, our total aggregate liability for all claims relating to Vizra will not exceed the greater of the amount you paid us for Vizra in the twelve months before the claim arose, or one hundred United States dollars (US$100).
12. Rights that cannot be waived
Some jurisdictions do not allow the exclusion of certain warranties, or the exclusion or limitation of liability for death, personal injury, fraud, or gross negligence. Nothing in these terms removes a right you have that cannot lawfully be removed. Where a limitation above is not permitted where you live, it does not apply to you, and the remaining terms stay in force.
13. Indemnification
You agree to indemnify and hold harmless Vizra and its owners, employees, and contractors from any claim, demand, loss, or expense, including reasonable legal fees, arising from your use of Vizra, your violation of these terms, your violation of any law or traffic regulation, or any content you submit, including false or malicious hazard reports.
14. Governing law and disputes
Governing law and venue are left blank on purpose. They depend on where the operating entity is formed and where it does business, and naming the wrong forum is worse than naming none. To be completed with counsel.
15. Changes to these terms
We may update these terms. Material changes will be made clear in the app rather than announced quietly here.
